CJPP India Chapter Amendment 3

In 2020, the IAB Legal Affairs Council launched the Cross-Jurisdiction Privacy Project (“CJPP”) with the goal of exploring how privacy laws in Australia, Brazil, Canada, China, India, Israel, Japan, Mexico, Nigeria, Singapore, and South Korea apply to the digital advertising industry. CJPP also provided an opportunity to examine how participants in digital ad transactions could more efficiently communicate their compliance with those laws through the IAB Tech Lab’s global privacy string. As a result, the IAB published the CJPP Compendium and CJPP Legal Specifications.

The amended CJPP India Chapter and Legal Specs provide an important and comprehensive update to the compendium’s India chapter given the recent enactment of the Digital Personal Data Protection Act, 2023 (DPDPA). The DPDPA is India’s first comprehensive data protection law and marks a significant step toward regulating data processing in the most populous nation in the world.

The amended chapter provides a comprehensive overview of the DPDPA, including:

  • Concrete use cases for the digital advertising industry.
  • Some important points of departure from the GDPR and other global privacy regulations.
  • Key issues related to consent, persistent unique identifiers, and personal information.
